This past Friday, the Dakota Access Pipeline quietly celebrated its first anniversary of service. More commonly known as "DAPL", what was once a national flashpoint between law enforcement and fossil fuel opponents has been largely forgotten. Perhaps some have wondered, what has happened with that pipeline in its inaugural year?

Answer: DAPL has been quietly transferring crude oil from the Bakken fields in North Dakota at a rate of over 500,000 barrels per day.

On October 18, 2018  two Standing Rock Sioux Tribe members and a pastor for an Episcopal Church on the reservation filed a class action civil lawsuit against state, county, and private law enforcement in the latest chapter of the Dakota Access pipeline (DAPL) saga. 
The plaintiffs allege that these groups were involved in a prolonged effort to blockade North Dakota State Highway 1806 to opponents of the controversial oil pipeline during the most heated protests from late October 2016 through early 2017.
The plaintiffs were Cissy Thunderhawk, Waste'Win Young, and Rev. John Floberg. They filed their lawsuit against Morton County, North Dakota, and its sheriff Kyle Kirchmeier, as well as the current and former North Dakota Governors, Doug Burgum and Jack Dalrymple, respectively, and the private security firm Tigerswan.

Farmer says Dakota Access Pipeline is destroying his land.

The Johnson family farm has been in Boone County for 132 years. But the installation of the Dakota Access Pipeline may be causing some issues. 
"They took all of the crops," says LaVerne Johnson. "They haven't paid me for crops in three years." 
The list of problems—from slower drainage to lack of productivity in the soil—caught Johnson's attention since the pipe was put in the ground three years ago. 
Local 5's Rafael Lopez shows you what environmentalists think are the next steps for farmers like Johnson.

Bent Mountain Pipeline tree-sitters appear in Virginia Court. Red and Minor Terry.

SALEM, Va. (WDBJ7) "Stand with Red" became a rallying cry for opponents of the Mountain Valley Pipeline. On Thursday afternoon, Red and Minor Terry had a crowd of supporters when the two tree-sitters faced misdemeanor charges in Roanoke County General District Court.
The mother and daughter climbed into their tree stands in early April, in an effort to prevent crews from cutting trees on their property.
And they came down in early May, after a federal judge found them in contempt and threatened hefty fines.
During the hearing Thursday, their attorney Tom Bondurant questioned officers about the police presence on the Terry property, and the decision to establish a perimeter around the two locations where the tree sitters were protesting.
Minor Terry said the women began their protest after a deadline for cutting in areas with endangered bats passed at the end of March. And she said they came down after a federal judge ruled against them.
After the hearing, Red Terry said she has no regrets.
"I got to meet a lot of these people here," she told reporters, "and I think we actually brought this to the attention of a lot of people."
Judge Scott Geddes is allowing the attorneys to file written briefs.
The Terrys are due back in court next Thursday for closing arguments in the case.

Roanoke County pipeline tree sitters stop in Shenandoah Valley


The mother and daughter came down from tree stands on Saturday after a federal judge ruled them in contempt and threatened a fine of $1,000 per day. Now the two are on a tour across Virginia to continue their fight.
The Terrys claim the Mountain Valley Pipeline will hurt their family's land and water throughout the Bent Mountain community in Roanoke County. Tree felling in the area has already begun.
"They wanted to make a point to the [Bent Mountain community] who has fought them non-stop that we run this place and I wanted to make a point to them," Red said. "Not yet you don't. Not yet. We're not done fighting."
She says the government should be doing more to help stop both the Atlantic Coast and Mountain Valley Pipelines.
"I feel like all the candidates and elected officials are puppets on strings," Red said. "Dominion and the power companies are running the country and telling our politicians what they want and what they can do and I'm tired of that."

Red Terry is a 61-year-old Virginia mountain woman who since April 2 has been living in a tree inside the white-and-blue-taped corridor marked out for the interstate Mountain Valley Pipeline. She and her 30-year-old daughter Minor, who is stationed in another tree not far away, are defending their land against what they see as a looming environmental catastrophe.
To get to Red’s tree sit, you’ve got to cross wooden boards that cross Bottom Creek numerous times. Water flows all around you, supporting wetland vegetation like skunk cabbage across the property, where the Terry family has lived for seven generations.
A judge ruled on Jan. 31, however, that the company may use eminent domain to take land along the pipeline’s 303-mile route from northern West Virginia to southern Virginia. After Red took to the trees, Roanoke County blocked supporters from giving her supplies, and it provided law enforcement officers to supplement MVP’s security guards. The first person I saw at the camp, in fact, was a camouflage-clad guard whose path through the woods helped me figure out where the bridges were.

Minnesota judge abruptly dismissed charges against three climate change activists during their trial on Tuesday, saying prosecutors had failed to prove that the protesters’ attempt to shut down two Enbridge Energy oil pipelines caused any damage.
The Clearwater county district judge Robert Tiffany threw the case out after prosecutors rested their case and before the protesters could use their defense: that the threat of climate change from using crude oil drilled from Canadian tar sands was so imminent that the activists’ actions were not only morally right, but necessary.
The attorneys had long fought to use a “necessity defense” during the trial of the three Seattle-area residents, two of whom admitted turning the emergency shut-off valves on the northwest Minnesota pipelines in 2016 as part of a coordinated action in four states. Such a defense has been used by other activists protesting against pipelines.

EPA just gave notice to dozens of scientific advisory board members that their time is up.

The Environmental Protection Agency has given notice to dozens of scientists that they will not be renewed in their roles in advising the agency, continuing a scientific shake-up that has already triggered resignations and charges from some researchers that the administration is politicizing the agency.
Members of the EPA’s Board of Scientific Counselors (BOSC) whose terms end in August will not see them renewed, according to an email sent to members and obtained by The Washington Post, though they can reapply for their posts. Moreover, five meetings of subcommittees of the board, planned for the late summer and the fall, will now be canceled because of lack of membership. They will be held once the board is reconstituted, according to EPA officials.
“It effectively wipes out the BOSC and leaves it free for a complete reappointment,” said Deborah Swackhamer, the current chair of the board’s executive committee and an emeritus professor of environmental health sciences at the University of Minnesota.

EPA Administrator Scott Pruitt formally initiated the repeal of the agency's Obama-era "Waters of the United States" rule that expanded federal protection of 20 million acres of wetlands and 2 million miles of streams.
In February, the president signed an executive order demanding the EPA "review and reconsider" the EPA's Clean Water Rule, to which agribusiness and fossil fuel companies alike objected and against which some 16 mostly rural states had filed suit in federal appeals court to block in 2015.
