Criminal investigation by US Customs

After a report from RSA Data Security, Inc., who were in a licensing dispute with regard to use of the RSA algorithm in PGP, the Customs Service started a criminal investigation of Zimmermann, for allegedly violating the Arms Export Control Act.^[2] The US Government had long regarded cryptographic software as a munition, and thus subject to arms trafficking export controls . On July 17, 2013, the Second Circuit Court of Appeals overturned the district court's permanent injunction blocking the indefinite detention powers of the NDAA because the plaintiffs lacked legal standing to challenge the indefinite detention powers of the NDAA. The Supreme Court declined to hear the case on April 28, 2014, leaving the Second Circuit decision intact.^[9]
